Your use of websites offered by affiliated providers will be subject to their own terms, codes of conduct
or guidelines that govern use of those sites. You agree to abide by such other terms and conditions and operating rules. This
Registered User Agreement in no way modifies or preempts the terms and conditions of the affiliated providers' websites. Your
violation of the terms and conditions of any affiliated provider's website while using RDC Painting, or by accessing those
sites through the RDC Painting Network, shall constitute a breach of this Agreement.
You are responsible for all activity made by you or anyone you allow to access RDC Painting, including your
children, other members of your family or friends. You are responsible for obtaining your own Internet access, including maintaining
all telephone, computer hardware and other equipment needed for access to and use of RDC Painting, and all charges related
thereto. Any telephone or other communications charges incurred by you to access RDC Painting are your responsibility.
Since these charges are your responsibility, you should contact your local telephone company or communication provider if
you have a question about whether your access carry any long distance charges or other toll charges from your location.
You May Use RDC Painting for Lawful Purposes OnlyYou may use RDC Painting's features, offerings and content for lawful purposes only. You agree to provide
RDC Painting with accurate, complete and updated registration information, and you agree to keep such information current.
You may not (1) select or use an identity of another person with the intention of impersonating that person, (2) use
a name of anyone else without authorization, (3) use a name in violation of the intellectual property rights of any person,
(4) use a name that RDC Painting considers to be offensive or (5) send unsolicited bulk e-mail, junk e-mail or unsolicited
bulk instant messages. You agree to abide by any operating rules posted by RDC Painting.
You may not post on or transmit through community areas (e.g., message boards, chat, e-mail, calendars, instant
messaging products) any material that (1) violates or infringes in any way upon the rights of others, (2) is unlawful, threatening,
abusive, defamatory, invasive of privacy or publicity rights, vulgar, obscene, profane, indecent or otherwise objectionable,
(3) encourages conduct that would constitute a criminal offense, (4) gives rise to civil liability or (5) otherwise violates
any law. You also may not undertake any conduct that, in RDC Painting's judgment, restricts or inhibits any other user from
using or enjoying RDC Painting, including without limitation the community areas.
You shall not upload, post or otherwise make available on any community areas such as message boards, chat,
webpages and instant messenger any material protected by copyright, trademark or other proprietary right without the express
permission of the owner of the copyright, trademark or other proprietary right. You are responsible for determining whether
copyright, trademark or other proprietary right protects such material. You shall be solely liable for any damages resulting
from any infringement of copyright, trademark or other proprietary right, or any other harm resulting from any uploading,
posting or submission.
Changes to the ServiceRDC Painting has the right at any time to change, modify, add to or discontinue any aspect or feature
of RDC Painting including, but not limited to, the community areas, content, hours of availability and equipment needed for
access or use. RDC Painting has no obligation to provide you notice of any such changes.
Your License to RDC Painting
You hereby grant to RDC Painting and the affiliated providers
a worldwide, royalty-free, perpetual, irrevocable and non-exclusive right and license to use, reproduce, modify, adapt, publish,
translate, create derivative works from, distribute, perform and display any material you post in the community areas and/or
any e-mail sent by you to RDC Painting or any of its affiliates (in whole or in part) and/or to incorporate such content in
other works in any form, media or technology now known or later developed.
The RDC Painting License to YouRDC Painting provides you with a limited license to use the software and services distributed by RDC Painting
("RDC Painting Software"), which you agree to use in accordance with these rules. You may not sub-license, or charge others
to use or access, RDC Painting's software without first obtaining written permission from RDC Painting.
RDC Painting grants to you a non-exclusive, limited license to use the RDC Painting Software and services
in accordance with this Agreement. This license is subject to the restriction that, except where expressly permitted by law,
you may not translate, reverse-engineer or reverse-compile or decompile, disassemble or make derivative works from the RDC
Painting Software. You may not modify the RDC Painting Software or use it in any way not expressly authorized by this Agreement.
You understand that RDC Painting's introduction of various technologies may not be consistent across all platforms and that
the performance and some features offered by RDC Painting may vary depending on your computer and other equipment.
Proprietary Rights
RDC Painting contains copyrighted material, trademarks and other proprietary information including text,
software, photos, video, graphics, music and sound, and the entire content of RDC Painting is copyrighted as a collective
work under the United States copyright laws. RDC Painting owns a copyright in the selection, coordination, arrangement and
enhancement of such content, as well as in the content original to it. Each third party content provider and the affiliated
providers own the copyright in content original to them.
You may not modify, publish, transmit, display, participate in the transfer or sale of, create derivative
works or in any way exploit the content of RDC Painting or any portion of it. Except as otherwise expressly permitted under
copyright law, you may not copy, redistribute, publish, display or commercially exploit any material from RDC Painting without
the express permission of RDC Painting and the copyright owner. No portion of the content on RDC Painting may be stored in
a computer except for personal and non-commercial use.
If you believe that your work has been copied and is accessible on RDC Painting in a way that constitutes
copyright infringement, please email ramadevicpainting@yahoo.com to contact RDC Painting.
No Endorsement
RDC Painting contains links to other web sites, resources and advertisers. RDC Painting is not
responsible for the availability of these external sites nor does it endorse, or is it responsible for, the aesthetics, appeal,
suitability to taste or subjective quality of informational content, advertising, products or other materials made available
on or through such external sites. Under no circumstances shall RDC Painting or any of the affiliated providers be held
responsible or liable, directly or indirectly, for any loss or damage caused or alleged to have been caused to you in connection
with the use of or reliance on any content, goods or services available on such external site. You should direct any concerns
to such external site's administrator or webmaster.
Disclaimer of Warranty; Limitation of LiabilityA.YOU EXPRESSLY AGREE THAT USE OF RDC PAINTING IS AT YOUR SOLE RISK. NONE OF THE RDC PAINTING Co.,THE AFFILIATED
PROVIDERS OR ANY OF THEIR RESPECTIVE AFFILIATES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS OR
LICENSORS (COLLECTIVELY, THE "RDC PAINTING PROVIDERS") WARRANT THAT RDC PAINTING AND FEATURES, OFFERINGS AND CONTENT PROVIDED
BY THE AFFILIATED PROVIDERS WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO THE RESULTS THAT MAY
BE OBTAINED FROM USE OF RDC PAINTING OR AS TO THE ACCURACY, RELIABILITY OR CONTENT OF ANY INFORMATION, SERVICE OR PRODUCTS
PROVIDED THROUGH RDC PAINTING OR THE AFFILIATED PROVIDERS.
B.RDC PAINTING PROVIDERS MAKE AVAILABLE THEIR SERVICES ON AN "AS IS", "AS AVAILABLE" BASIS WITHOUT WARRANTIES
OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY
OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION
OR MODIFICATION UNDER THE LAWS APPLICABLE TO THE TERMS OF SERVICE.
C.THE DISCLAIMERS OF LIABILITY BY RDC PAINTING PROVIDERS CONTAINED IN THIS SECTION APPLY TO ANY DAMAGES OR
INJURY CAUSED BY ANY (I) FAILURE OF PERFORMANCE, (II) ERROR, (III) OMISSION, (IV) INTERRUPTION, (V) DELETION, (VI) DEFECT,
(VII) DELAY IN OPERATION OR TRANSMISSION, (VIII) COMPUTER VIRUS, (IX) COMMUNICATION LINE FAILURE OR (X) THEFT, DESTRUCTION
OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF RECORD, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR, NEGLIGENCE
OR UNDER ANY OTHER CAUSE OF ACTION. YOU SPECIFICALLY ACKNOWLEDGE THAT NONE OF RDC PAINTING PROVIDERS IS LIABLE FOR THE DEFAMATORY,
OFFENSIVE OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD PARTIES AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY
WITH YOU.
D.IN NO EVENT WILL ANY RDC PAINTING PROVIDER OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING OR DISTRIBUTING
THE SERVICES OFFERED BY RDC PAINTING PROVIDERS BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES
ARISING OUT OF THE USE OF OR INABILITY TO USE THE FEATURES AND CONTENT PROVIDED BY RDC PAINTING PROVIDERS OR OUT OF THE BREACH
OF ANY WARRANTY. YOU HEREBY ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL CONTENT PROVIDED BY RDC PAINTING
PROVIDERS. RDC PAINTINGPROVIDERS' LIABILITY, IF ANY, TO A USER SHALL IN NO EVENT EXCEED THE TOTAL AMOUNT PAID TO RDC PAINTING
BY SUCH USER.
E.RDC PAINTING PROVIDERS NEITHER ENDORSE NOR ARE RESPONSIBLE FOR THE ACCURACY OR RELIABILITY OF ANY OPINION,
ADVICE OR STATEMENT OFFERED THROUGH RDC PAINTING, NOR FOR ANY OFFENSIVE, DEFAMATORY OR OBSCENE POSTING MADE ON THE COMMUNITY
AREAS BY ANYONE OTHER THAN AUTHORIZED RDC PAINTING SPOKESPERSONS WHILE ACTING IN THEIR OFFICIAL CAPACITIES. UNDER NO CIRCUMSTANCES
WILL ANY OF RDC PAINTING PROVIDERS BE LIABLE FOR ANY LOSS OR DAMAGE CAUSED BY YOUR RELIANCE ON INFORMATION OBTAINED THROUGH

THE ACCURACY, COMPLETENESS OR USEFULNESS OF ANY INFORMATION, OPINION, ADVICE OR OTHER CONTENT AVAILABLE THROUGH THE RDC PAINTING

OR SERVICES. AS WITH THE PURCHASE OF A PRODUCT OR SERVICE THROUGH ANY MEDIUM OR IN ANY ENVIRONMENT, YOU SHOULD USE YOUR BEST
JUDGMENT AND EXERCISE CAUTION WHERE APPROPRIATE. RDC PAINTING PROVIDERS MAKE PRODUCTS OR SERVICES AVAILABLE ON RDC PAINTING
WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES
OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF
EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THE TERMS OF SERVICE.
G.PRIOR TO THE EXECUTION OF A PURCHASE OR SALE OF ANY SECURITY OR INVESTMENT, YOU ARE ADVISED TO CONSULT WITH
YOUR BROKER OR OTHER FINANCIAL ADVISOR TO VERIFY PRICING AND OTHER INFORMATION. NONE OF RDC PAINTING PROVIDERS SHALL HAVE
ANY LIABILITY FOR INVESTMENT DECISIONS BASED UPON, OR THE RESULTS OBTAINED FROM, THE CONTENT PROVIDED HEREIN. NONE OF RDC
PAINTING PROVIDERS GUARANTEE OR WARRANT THE TIMELINESS, SEQUENCE, ACCURACY OR COMPLETENESS OF ANY SUCH INFORMATION. NOTHING
CONTAINED IN THE NETSCAPE NETWORK SHALL BE CONSTRUED AS INVESTMENT ADVICE. NONE OF THE RDC PAINTING PROVIDERS IS A REGISTERED
BROKER-DEALER OR INVESTMENT ADVISOR, AND NONE OF THEM GIVES INVESTMENT ADVICE OR RECOMMENDS ONE PRODUCT OVER ANOTHER.
IndemnificationYou agree to defend, indemnify and hold harmless the RDC Painting Providers and their respective
directors, officers, employees and agents from and against all claims and expenses, including attorneys' fees, arising out
of your use of RDC Painting.
TerminationRDC Painting has the right to terminate your access to RDC Painting and other RDC Painting properties
for any reason, including, without limitation, if it, in its sole discretion, considers your use to be unacceptable, or in
the event of any breach by you of the Terms of Service (either directly or through breach of any other terms and conditions
or operating rules applicable to you). RDC Painting may, but shall be under no obligation to, provide you a warning prior
to termination of your use of RDC Painting.
Trademarks
All trademarks appearing on RDC Painting are the property of their respective owners, including, in some
instances, RDC Painting and its affiliates, including, without limitation.
MiscellaneousA.The provisions of this Registered User Agreement addressing disclaimers of representations and warranties,
indemnity obligations, intellectual property, Subscriptions and governing law shall survive the termination of this Agreement,
your Subscriptions and your registration with RDC Painting.
B.This Registered User Agreement and any operating rules for any areas of functionality of RDC Painting established
by RDC Painting constitute the entire agreement between RDC Painting and you regarding the subject matter of this Registered
User Agreement, and supersede all previous written or oral agreements. This Registered User Agreement shall be deemed supplemented
by other terms of service or operating rules for any particular content, software, tools, services or functionality, except
that in the event of any inconsistency between this Registered User Agreement and any such other terms of use or operating
rules, this Registered User Agreement will supersede such other terms of sue or operating rules. The Terms of Service and
Registered User Agreement shall be governed by and construed in accordance with the laws of California, without regard to
its conflict of laws rules. You expressly agree that the exclusive jurisdiction for any claim or dispute under the Terms of
Service and Member Agreement or your use of RDC Painting resides in the courts located in California, and you further expressly
agree to submit to the personal jurisdiction of such courts for the purpose of litigating any such claim or action. No waiver
by either party of any breach or default hereunder shall be deemed to be a waiver of any preceding or subsequent breach or
default. The section headings used herein are for convenience only and shall not be given any legal import. The Webmaster operates
RDC Painting.
